According to the lawsuit, plaintiffs allege that the clothing retailer intentionally misrepresented its sales in order to mislead consumers. Old Navy allegedly advertised some products as “on sale” with a referenced “regular” list price. However, despite this labeling, the “sale” items were allegedly never sold at the false reference price.

- Estimated Amount: Settlement Purchase Certificates
- Tier 1 claimants — Those who do not submit proof of qualifying purchase(s) or who submit proof of qualifying purchase(s) that are less than $90 with his or her timely and valid claim form will receive a Settlement Purchase Certificate for $5 for any purchase or off any purchase (no minimum purchase required).
- Tier 2 claimants — Those who had qualifying purchase(s) totaling $90 or more during the Class Period and submit proof of such purchase(s) with their timely and valid claim form will receive two Settlement Purchase Certificates for a total value of $10 for any purchase or off any purchase (no minimum purchase required).
- Proof of Purchase: No proof of purchase is required for Tier 1 claimants. Tier 2 claimants must submit either receipt(s) clearly showing the date of purchase(s) and the total of the purchase(s), or a credit or debit card transaction record that clearly shows the purchase date and purchase total.
